1. Who we are and who may use the Service
Arteamente is an editorial website about Italian and European art, culture, and places, published from Italy and written primarily for readers in the United States and Canada.
You must be at least eighteen years old and able to enter into a binding contract to use the paid or interactive parts of the Service. Anyone may read our published content. You may not use the Service if we have previously suspended you.
2. What we provide
We publish articles, guides, itineraries, photographs, and other material about art, museums, opera and the performing arts, historic places, and travel in Italy and Europe. We also publish a newsletter, and we may from time to time offer digital products.
The Service is provided for personal, non-commercial use. We may change, suspend, or discontinue any part of it at any time.
3. Travel and cultural information is not advice
Everything we publish is general information for a broad audience. It is not travel advice, safety advice, health advice, immigration advice, or professional advice of any kind, and it is not prepared with your circumstances in mind.
Opening hours, ticket prices, closures, exhibition dates, transport connections, entry requirements, and accessibility arrangements change frequently and without notice, and information that was accurate when published may be wrong by the time you read it. Always verify with the museum, venue, operator, or official authority before you travel or buy a ticket.
You are responsible for your own travel decisions, including passports and visas, health and vaccination requirements, travel insurance, and compliance with the laws of the places you visit. Consult official government sources for your country of citizenship, and a qualified professional where your circumstances require one.
4. Bookings and purchases are made with third parties
We are not a travel agency, a tour operator, a ticket seller, or an accommodation provider. We do not sell, arrange, or broker travel services, and we take no part in any contract you enter into with a third party.
When you follow a link from our Site to a booking platform, a museum, a hotel, a tour operator, or any other merchant, the resulting transaction is entirely between you and that provider, and is governed by their terms and their cancellation and refund policies. Prices, availability, and conditions shown on our Site are indicative and may differ from those you find on the provider’s own site.
We are not responsible for any act or omission of those providers, including cancellation, overbooking, changes to a service, refusal of entry, loss or damage to property, injury, or failure to provide what was booked. Any complaint about a booking must be raised with the provider.
5. Advertising and affiliate relationships
The Service is funded by advertising and by affiliate commissions. Some links are affiliate links: if you click one and then book or buy, we may receive a commission from the merchant, at no additional cost to you. We take part in the Amazon Associates Program and in travel affiliate programmes including Booking.com, GetYourGuide, and Viator.
We do not control which advertisements appear on our pages, and the presence of an advertisement is not an endorsement of the advertiser. Commercial relationships do not determine what we cover or what we conclude. Full details are in our Affiliate Disclosure.
6. Newsletter
You may subscribe to our email newsletter by giving your express consent. You may unsubscribe at any time using the link included in every message, and we will act on your request promptly. How we handle your email address is described in our Privacy Policy.
7. Your content and comments
If you post a comment, send us a message, or submit a photograph or other material, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display it in connection with the Service, and to edit it for length and clarity.
You confirm that you own or have permission to share what you submit, and that it does not infringe anyone’s rights. Do not submit confidential information or personal information about other people. We moderate comments and may remove any submission, without notice, at our discretion. Comments express the views of their authors, not ours, and are not advice.
8. Digital products
Where we offer digital products such as guides or ebooks, the following applies.
- Prices are shown on the relevant page and are in the currency indicated. Taxes are added where applicable.
- Payment is processed by PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg). Your payment credentials are handled by PayPal, not by us. By paying, you confirm you are authorized to use the payment method.
- Products are delivered digitally, usually immediately. At checkout you will be asked to confirm that you want delivery to begin at once and that you understand you lose any statutory right of withdrawal once delivery is complete.
- Refunds are governed by our Refund Policy, which forms part of these Terms.
- Digital products are licensed to you for personal use. You may not resell, share, or redistribute them.
9. Donations
Where we invite voluntary contributions in support of our editorial work, a donation is a gift and not a purchase. You receive no goods, services, membership, or preferential treatment in return, and no advertising is removed or content unlocked as a result. Donations are processed by PayPal and are not tax-deductible. Donations are non-refundable, except where a payment was made in error or without authorization, in which case write to us and we will refund it.
10. Acceptable use
You agree not to:
- copy, scrape, mirror, or republish our content without written permission, except for brief quotations with clear attribution and a link to the original page;
- use automated systems to access the Service in a way that imposes an unreasonable load, or to collect our content for training machine learning models without our written permission;
- reproduce or redistribute our photographs, illustrations, or maps in any form without written permission;
- attempt to gain unauthorized access to the Service or interfere with its operation;
- use the Service for anything unlawful, misleading, defamatory, or harmful;
- post spam, promotional links, or automated comments.
11. Intellectual property
All content on the Service, including text, photographs, illustrations, design, and software, belongs to Light S.r.l.s. or to our licensors and is protected by copyright and other laws. We grant you a limited, personal, revocable, non-transferable licence to access and read it.
Images of artworks, buildings, and cultural sites may be subject to additional rights held by museums, institutions, or photographers, and to national rules on the reproduction of cultural heritage. Nothing here grants you any right to reuse them. Copyright complaints are handled under our Copyright and DMCA Policy. To request permission to reuse our material, write to info@arteamente.it.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that any information on the Service is accurate, complete, current, or applicable to your situation.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or opportunity, or for any cost, loss, or disruption to travel arrangements, arising out of or in connection with the Service or with your reliance on anything published on it, whether based in contract, tort, statute, or otherwise.
Our total liability for all claims relating to the Service in any twelve-month period will not exceed the greater of the amount you paid us in that period or fifty euro.
Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.
14. Indemnity, suspension and termination
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these Terms, your misuse of the Service, or your infringement of anyone’s rights.
We may suspend or terminate your access at any time if you breach these Terms or if we reasonably believe your use harms the Service or other users. You may stop using the Service at any time. Sections 7, 11, 12, 13, and 14 survive termination.
15. Changes, governing law and disputes
We may amend these Terms; the date at the top shows the last revision. If the changes are material, we will give notice on the Site or by email before they take effect. Continued use after that date means you accept the amended Terms.
These Terms are governed by the laws of Italy, without regard to conflict of law rules. The courts of [COURT / CITY], Italy, have jurisdiction.
If you are a consumer resident in the United States, Canada, or the European Union, this clause does not deprive you of the protection of the mandatory consumer laws of the place where you live, and you may bring proceedings in your local courts where the law gives you that right.
Before starting formal proceedings, we ask you to write to info@arteamente.it so that we can try to resolve the matter directly. Consumers in the European Union may also use the European Commission’s online dispute resolution platform.
16. General and contact
If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, the Cookie Policy, the Disclaimer, and the Affiliate Disclosure, are the entire agreement between us regarding the Service.
